1. The service
Virtual Viewfinder ("the app") is an augmented reality previsualization tool published by [[COMPANY]] ("we", "us"). It is intended for internal professional use by staff, contractors, and production partners of [[COMPANY]]. It is not a general-purpose consumer product and is not sold to the public.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, solely for work authorised by [[COMPANY]] and subject to these terms: for the iOS app, on Apple-branded devices and also subject to the Apple Media Services Terms; for the Android app, on devices that support Google Play Services for AR, installed from the download page we provide. All rights not expressly granted are reserved.
You may not:
- copy, sell, rent, sublicense, or otherwise distribute the app;
- reverse engineer, decompile, or disassemble it, except to the extent that applicable law expressly permits this despite this limitation;
- remove or alter any proprietary notices;
- use the app to build a competing product, or to circumvent access controls on the service.
3. Accounts
Access requires an account issued by a [[COMPANY]] administrator. You are responsible for keeping your credentials confidential and for everything done under your account. Do not share your account. Tell us at [[SUPPORT_EMAIL]] immediately if you believe it has been compromised. We may suspend, disable, or close an account at any time — for example when someone leaves the organisation, or where use breaches these terms.
4. Acceptable use
You agree not to use the app:
- in any way that is unlawful, or that infringes anyone's rights;
- to capture images of people or private places without the consent and permissions that the location and applicable law require;
- on locations or sets you are not authorised to be on;
- to upload content you do not have the rights to use, or that is unlawful, defamatory, or infringing;
- to interfere with, overload, probe, or attempt to gain unauthorised access to the service or its infrastructure.
You are responsible for complying with the rules of the place you are working in, including any filming, safety, and site access policies.
5. Your content
You keep ownership of the scenes, assets, thumbnails, and other material you or your organisation upload ("your content"). You grant us the licence needed to host, store, transmit, display, and process your content for the purpose of operating the service for you and your organisation. You are responsible for having the rights to the content you upload. We may remove content that breaches these terms.
6. Our content
The app, the service, and everything in them that we provide — software, interfaces, documentation, and branding — belong to [[COMPANY]] or its licensors and are protected by intellectual property law. These terms grant you no rights in our trademarks.
7. Safety on location
The app puts virtual people and props over a live camera view. Pay attention to your physical surroundings while using it. Do not use it while driving or operating equipment, and follow the safety rules of your set or site. Augmented reality tracking is approximate: measurements, placement, and framing shown in the app are a previsualization aid and must not be relied on as survey-grade measurements or as the sole basis for safety-critical or structural decisions.
8. Availability and changes
We may change, suspend, or discontinue any part of the app or the service, and we may update the app and require you to install updates in order to keep using it. We do not promise the service will be uninterrupted or error-free.
9. Disclaimers
To the maximum extent permitted by law, the app and the service are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, [[COMPANY]] will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost production time, or lost or corrupted data, arising out of or relating to your use of the app. Our total liability for all claims relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or [[LIABILITY_CAP]].
11. Termination
These terms apply until terminated. Your licence ends automatically if you breach them, and we may terminate it at any time when your authorisation to use the app ends. On termination you must stop using the app and delete it from your devices. Sections that by their nature should survive — including content ownership, disclaimers, limitation of liability, and governing law — survive termination.
12. Apple and Google
iOS app. This agreement is between you and [[COMPANY]] only, not with Apple. [[COMPANY]], not Apple, is solely responsible for the app and its content, for maintenance and support, for any product warranty claims, for addressing any claim that the app infringes intellectual property rights, and for handling any claim that the app fails to conform to applicable law. Apple has no obligation to furnish maintenance or support for the app. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Android app. The Android app is not distributed through Google Play and requires Google Play Services for AR (ARCore), which Google LLC provides under its own terms and privacy policy. This agreement is between you and [[COMPANY]] only; Google is not a party to it and has no obligation to furnish maintenance or support for the app.
13. Governing law
These terms are governed by the laws of [[JURISDICTION]], without regard to its conflict of law rules, and the courts of [[JURISDICTION]] have exclusive jurisdiction over any dispute, except where mandatory local law gives you the right to bring proceedings elsewhere.
14. Changes to these terms
We may update these terms. The "last updated" date above will change, and continued use of the app after an update means you accept the revised terms. If you do not accept them, stop using the app.
